Course Overview
A training course on aviation law and litigation for CAA (Civil Aviation Authority) lawyers aims to equip these legal professionals with the knowledge, skills, and tools they need to effectively carry out their responsibilities within the aviation sector.
Course Outline
Day 1: Foundational Knowledge
- Introduce and deepen the understanding of the core principles of aviation law, both national and international. This would include the conventions, treaties, and regulations that govern the aviation sector.
- Litigation Skills: Enhance practical litigation skills specifically tailored to aviation disputes.This might include understanding specific evidentiary issues, procedures, or strategies unique to aviation litigation.
- Understanding Regulatory Frameworks: Provide a comprehensive understanding of the regulatory landscape, including the role and mandate of the CAA and how it interacts with other national and international bodies.
Day 2: Safety and Security
- Dive deep into laws and regulations pertaining to the safety and security of flight operations, airports, and air navigation services, as these are paramount in aviation.
- Consumer Protection: Understand and interpret regulations related to passenger rights, such as compensation for delays, cancellations, lost luggage, and other related issues.
- Dispute Resolution: Equip lawyers with tools and knowledge to mediate or adjudicate disputes within the aviation sector, whether they involve airlines, service providers, or consumers. Explore venues for dispute resolutions and jurisdictions.
Day 3: Case Studies
- Analyze past legal cases and decisions in aviation to draw lessons and understand precedent. This could be particularly insightful for areas that are legally contentious or evolving. Major litigation cases involving aviation. Explore aviation insurance litigation.
- International Cooperation: Explore the complexities of international aviation agreements, bilateral air service agreements, and the role of international organizations like the International Civil Aviation Organization (ICAO).
Day 4: Investigative Procedures
